Terms and Conditions

• Deposit & Refunds

  $200 cash required to bid. Deposit money will be applied to the purchase price of any vehicles in which you place the winning bid. If you do not purchase a vehicle at the auction, your deposit will be refunded to you at the completion of the auction, or at the time you turn in your bidder’s card. You have until 4 p.m. on the date following the auction to turn in your bidder’s card for a refund of your deposit. After that period, the deposit will be retained by Western Towing.

• Review & Inspection

  Please inspect the vehicles and auction list provided to you closely for year, make, model and condition before bidding. Your bid is final and irrevocable.

• All Sales As Is

  All sales are FINAL on an “AS IS WHERE IS” basis, without warranties or guarantees express, implied or promised on ALL vehicles sold. Each potential Buyer agrees that any vehicle being sold by the Western is sold “as is” and that Western has not agreed to or promised any type of guarantee or warranty, whether expressly written or implied. The Buyer also agrees that Western shall not be responsible for any defects, repairs or other costs that may be associated with any vehicle being sold by Western to the Buyer. Bidder and the Western agree that the terms of the sale of any vehicle purchased at this action does not contain any other commitments, covenants or promises other than those contained in these terms and conditions.

• Fees

  All vehicles sole will be assessed a buyer and a key fee. A. Buyer fee for each vehicle is $20. B. Key fee for each vehicle will vary, but is a minimum of $15.

• Vehicles Sold Over $1000

  For any vehicle purchased over $1,000, a down payment of at least $200 will be required in addition to the $200 deposit previously provided to Western Towing.

• Payment For & Release of Vehicles Purchased

  All vehicles purchased must be paid for in full by 4 p.m. on the day following the auction. In addition, all vehicles purchased must be removed from the Western Towing lot by 4 p.m. on the day following the auction. Vehicles not paid for and removed by the date and time specified will result in loss of deposit and/or down payment money. There are NO EXCEPTIONS to this policy.

• Assumption of the Risk/Release

  All bidders and other entrants of the Western property acknowledge that he/she are voluntarily participating in the auction. All individuals entering onto Western’s property agree and acknowledge that there are risks and hazards which may be present on the Western Towing premises before, during or after the auction, which may result in physical injury. Injury to person or property may result from Bidder’s or other’s actions, inactions, negligence or the condition of the auction location/facilities. All individuals entering onto the auction premises agree to assume all risks of participation in the auction, whether known or unknown, and in consideration for being allowed to participate in the auction, release from all liability and waive all rights to sue Western Towing, and their employees, officers, volunteers, agents and/or affiliates. Individuals entering Western’s lot for auction further agree to defend and hold Western Towing harmless from any and all claims, including claims of Western’s negligence, resulting in any loss or damage to property, physical injury, illness (including death), liabilities and costs, including attorney’s fees, that any entrant, Bidder or Western may suffer or which may result from participation in Western Towing’s auction, or any events incidental to the auction.

• No Repairs on Premises

  No repairs or parts removed may be removed in the auction yard.

• No Minor or Pets

  No children or pets are allowed in the Western Towing yard before, during or after the auction.

• No Alcohol/Drugs

  No alcohol or drugs are permitted on the Western Towing premises at any time.
